I, [Parent Name] (parent), am the parent or legal guardian of [Student Name] (student), who is enrolling to participate in one or more Mulholland Prep test prep or academic tutoring, admissions counseling, or class offerings. Mulholland Prep endeavors to provide the highest quality academic, admissions counseling, and test preparation possible, but we offer no guarantee of a particular result, acceptance, or score improvement.
PLEASE READ CAREFULLY:
- Tutoring Environment
- Location: Tutors are contractually prohibited from tutoring in a child's bedroom or any room with a closed door. I warrant that I will provide an appropriate, distraction-free common area.
- Supervision: If the student is under 18, a parent or guardian must be present in the home during the session. If no guardian is present upon the tutor's arrival, the session will be cancelled and the full session time will be owed.
- Billing
- Billing Increments: Mulholland Prep will send invoices via e-mail on a roughly monthly basis. I understand that Mulholland Prep charges in 15-minute increments for all work: virtual and in-person meetings, application or essay review, and communication (phone calls, e-mails, and text messages that extend beyond 15 minutes).
- Rate Surcharge: All quoted rates are for virtual tutoring/counseling; an additional 20% surcharge will be applied to all in-person meetings to cover travel and expenses.
- Late Cancellation
If a tutoring session is cancelled with less than 24 hours' notice, there will be a $75 session cancellation fee.
- No-Show Policy: If the counselor or tutor appears online or arrives at the student's location but no one is present, I understand I will be charged for the full planned session time at the standard rate.
- Payment Liability and Collections
By signing this agreement, I acknowledge full legal and financial responsibility for all accrued charges generated by the student or requested by the parent/guardian. I understand that:
- Payment Protocol: I understand that payment is to be transacted only with Mulholland Prep's office and staff, and not with the counselors or tutors directly.
- Late Fees: Mulholland Prep reserves the right to apply late fees to any invoice not paid within 30 days of the invoice date.
- Default and Collections: In the event of non-payment, Mulholland Prep reserves the right to suspend all services immediately. If an account remains unpaid for more than 60 days, the account will be considered in default.
- Legal/Collection Costs: I agree to pay all costs of collection, including but not limited to reasonable attorney's fees, court costs, and a 33% collection agency fee, should my account be referred to a third-party collection agency or legal counsel for recovery of unpaid balances.
- Waiver and Indemnity
In consideration for participation, I, for myself and my heirs, hereby release, waive, and discharge Mulholland Prep, its officers, and agents from liability for any and all claims or damages arising from participation.
I also agree to indemnify and hold Mulholland Prep harmless from any and all claims, actions, suits, and procedures, costs, expenses, damages and liabilities, including attorneys fees brought as a result of my child's involvement in a Mulholland Prep class, tutorial, or counseling offering.
I have read this agreement carefully and fully understand and agree to its terms. I acknowledge that I am signing this document freely and voluntarily, and understand that by signing below I am providing a complete and unconditional release of liability to the greatest extent allowed by law.
